Govik Industries Private Limited, a private company, incorporated under the Companies Act, 1956 allotted Corporate Identification Number (CIN) U32109MH1990PTC056660 and having its registered office at Office No. 720, 7th Floor, Tulsiani Chambers, Free Press Journal Road, 212, Nariman Point, Mumbai, Maharashtra – 400021, India, (hereinafter referred to as ‘Govik) is the owner of the domains, www.govik.com, www.arvettiliving.com and www.govikinteriors.com (hereinafter referred to as the ‘GOVIK Websites’).

The User hereby acknowledges and agrees that the Privacy Policy is subject to changes without express and specific intimation and the User will be required to review the Privacy Policy regularly. The continued use of the GOVIK Websites expresses the User’s consent to the updated Privacy Policy. The Privacy Policy discloses Govik’s practice with respect to the Personally Identifiable Information provided by Users through the Contact Form available on the GOVIK Websites. By using the GOVIK Websites and / or providing information through the Contact Form, the User agrees to accept the terms of this Privacy Policy as provided on the GOVIK Websites. By accessing or using the GOVIK Websites, the User expressly consents to Govik’s use and disclosure of the User’s Personally Identifiable Information in the manner described in this Privacy Policy.

If the User does not agree with the terms of this Privacy Policy, the User is requested to cease from using the GOVIK Websites and / or providing any information through the Contact Form.

  1. DEFINITIONS
  • Channel Partner means and refers to those persons associated with Govik as resellers, distributors, dealers and / or professional service providers;
  • Entity means and includes an artificial and / or juridical person, company, firm, association of persons, whether incorporated or not, government and / or local authority, more specifically;
    1. a company, corporation, trust, firm, limited liability partnership, or similar legal entity (excluding affiliates or subsidiaries which will be treated as a separate Entity);
    2. an agency / sub-department of a department of a government or local authority; and
    3. a non-governmental organization or non-profit organization;
  • Personally Identifiable Information means any data or information that is personal to a User and allows persons other than the User to identify the User personally from such data or information:
  • Privacy Policy shall mean this Privacy Policy; and
  • User shall mean and refer to the individual or Entity who accesses or uses the GOVIK Websites and/or provides information in the Contact Form.
  1. COLLECTIONS AND USE OF INFORMATION
  • The User may provide information for the purposes mentioned on the relevant page in the Contact Form available on the GOVIK Websites. Govik will collect and store the information, including Personally Identifiable Information, provided by the Users from time to time.
  • The User has the option of not providing Personally Identifiable Information. However, the User understands and acknowledges that such Personally Identifiable Information is necessary for Govik to contact the User in case of queries or business requests with respect to Govik’s products and services.
  • Upon a written request by the User, Govik will remove/delete the User’s Personally Identifiable Information from Govik’s database. However, the User’s Personally Identifiable Information (limited to the information Govik is authorized to collect and store) may remain stored in archive on the servers even after the deletion.
  • The Personally Identifiable Information received by Govik will be dealt with only for the purpose of provision of contacting the User by Govik or any of Govik’s Channel Partners. You expressly authorize Govik to share your Personally Identifiable Information with its Channel Partners. Govik may use such Personally Identifiable Information to send e-mails, newsletters and postal mails to keep Users informed and updated about its products and services. Further, Govik may use a User’s Personally Identifiable Information for feedback purposes to improve its products and services and Govik’s marketing and promotional efforts.
  1. STORING OF INFORMATION
  • The Personally Identifiable Information provided by a User from time to time while using the GOVIK Websites will be stored by Govik on standard servers with standard security provisions and encryptions.
  • Govik may also use cookies to collect, track and store information based on the User’s use of the GOVIK Websites. By using the GOVIK Websites, the Users are set to accept cookies and consent to Govik’s use of cookies.
  1. SHARING OF INFORMATION
  • The Personally Identifiable Information will be accessed only by persons required to access the information and shall not be shared with any third party and shall not be viewed by any person other than Govik, its affiliates and associate companies, directors, officers, employees, Channel Partners, if and when required. The User expressly waives any objection to Govik sharing such Personally Identifiable Information with aforementioned persons.
  • Govik’s commitment to protect Users’ Personally Identifiable Information is subject to Govik’s requirements under applicable law and Govik reserves the right to cooperate fully with governmental authorities, private investigators and/or injured third parties in the investigation of any suspected criminal or civil wrongdoing. Further, Govik may disclose the User’s identity and contact information, if requested by a government or law enforcement body or under any other legal action or where such disclosure is required to be made to a government agency mandated under the law to obtain such Personally Identifiable Information. The User expressly acknowledges that Govik shall not be liable for damages or results arising from such disclosure and the User agrees not to bring any action or claim against Govik for such disclosure.
  1. SECURITY PRECAUTIONS
  • Govik has implemented appropriate physical, electronic, and managerial procedures to safeguard and help prevent unauthorized access to the Personally Identifiable Information of the User and to maintain data security. These safeguards consider the sensitivity of the Personally Identifiable Information that Govik collects, process and stores and the current state of technology. Govik follows generally accepted industry standards to protect the Personally Identifiable Information submitted to it. However, no method of transmission over the Internet, or method of electronic storage, is completely secure. Therefore, while Govik strives to use acceptable industrial standards to protect the Personally Identifiable Information of the Users, Govik cannot guarantee its absolute security.
  • Govik assumes no liability or responsibility for disclosure of the User’s Personally Identifiable Information due to errors in transmission, unauthorized third-party access, or other causes beyond Govik’s control.
  • Notwithstanding anything contained in the Privacy Policy or elsewhere, Govik shall not be held responsible for any loss, damage or misuse of the User’s Personally Identifiable Information, if such loss, damage or misuse is attributable to a Force Majeure Event (defined herein under).
  1. FORCE MAJEURE
The User agrees that Govik will not be held liable for any loss or damage with respect to the use of the GOVIK Websites, if the same arises out of any cause due to which Govik is wholly or partly unable to perform its obligations and which is not reasonably within the control of Govik. Further, Govik will not liable for any loss or damage which is not a result of the fault or negligence of Govik or which occurs despite all reasonable attempts of Govik to avoid or mitigate the same. This includes without limitation, penetration events such as hacking, malware, etc., internet outage, server breakdowns, server downtime, system incompatibility, strikes, labour disputes, lockouts, war, acts of terror, riot, acts of God or governmental action and / or restrictions and other events or circumstances that are beyond the reasonable control of Govik (‘Force Majeure Event’).
  1. DISPUTE RESOLUTION AND GOVERNING LAW
  • The terms of this Privacy Policy shall be governed by the substantive laws of India, without giving effect to the conflicts of law principles of any jurisdiction.
  • Any dispute arising out of or in connection with this Privacy Policy, including any question regarding its existence, validity or termination, shall be referred to and finally resolved by arbitration. The seat of the arbitration shall be Mumbai, India. The Tribunal shall consist of one arbitrator, selected from the panel of arbitrators with technical experience in the field of information technology. The language of the arbitration shall be English. The law governing this arbitration agreement shall be the Arbitration and Conciliation Act, 1996 (as amended and re-enacted at the relevant time). The law governing the Privacy Policy shall be the law of the Republic of India, without giving effect to the conflicts of law principles of any jurisdiction.
